CIVIL PROCESS:

The Brown County Sheriff’s Office has the responsibility of serving and executing court issued documents. We also serve other legal documents as received from the courts, attorneys and private citizens.

The fees charged as set by state statute SDCL 7-12-18.  At this time the fee for serving most types of documents is $50 plus mileage.  The Sheriff’s Office charges $0.55 cents per mile with a minimum of three miles.  Subpoenas are $20 plus mileage.  The fees charged on executions and distress warrants are also set by state law and vary with each case depending if levies, towing or publication expenses apply. There is no fee charged for service of protection orders.

A deposit of $75 per defendant is charged to parties out of state.
